Filing Rule for Federal Covered Securities Described in Section 18(b)(4)(D) of the Securities Act of 1933

Vermont Proposed Rule: 08P035

AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration

CONCISE SUMMARY: This Rule will implement the provisions of the Vermont Securities Act, 9 V.S.A. § 5302(c), which authorize the filing of certain "federal covered securities" which federal law permits states to require filing, but preempts state regulation of the filings. The Vermont statute allows the state to require these filings, but only pursuant to the adoption of an administrative rule. Vermont law establishes a filing fee to accompany the filing of federal covered securities, pursuant to 9 V.S.A. § 5302(e).

TYPE OF PERSONS AFFECTED: (1) Individuals and entities required to file federal covered securities. (2) The State of Vermont can anticipate an increase in fee revenue as a result of the filing requirement.

COST BENEFIT ANALYSIS: Individuals and entities required to file under the proposed rule will be required to file a fee calculated pursuant to 9 V.S.A. § 5302(e) [$600 per filing].

Vermont Milk Commission Procedure: Development and Issuance of an Order to Establish a Retail Fluid Milk Premium, or Amendment of Such Order.

Vermont Proposed Rule: 08P036

AGENCY: Agriculture, Food & Markets

CONCISE SUMMARY: The rule sets forth the Milk Commission's procedure for establishing or amending a retail fluid milk premium order, which is authorized by 6 V.S.A. § 2924. The rule also applies to other subjects or issues that require administrative process relating to the Milk Commission's establishment or amendment of an order involving a retail fluid milk premium.

TYPE OF PERSONS AFFECTED: Vermont Agency of Agriculture, Food and Markets, Vermont Milk Commission, any person organization, or entity with an interest in a retail fluid milk premium order, including dairy farmers, dairy processers, dairy retailers, dairy food organizations, farm organizations and private, non-profit, and government entities.

COST BENEFIT ANALYSIS: This procedural rule will have no discernable economic impact on the public or any dairy farmers, dairy product processors, retailers, or any person, organization or entity with an interest in a fluid milk premium order. The rule will require the Milk Commission to publish public notice in newspapers of record but this cost is de minimus and required by 6 V.S.A. § 2929(b)(1) and the Administrative Procedures Act.
