PROPOSED STATE RULES

Amendments to the Vermont Health Access Program (VHAP), Employer-Sponsored Insurance Assistance (ESIA) Program, and the Catamount Health Assistance Program (CHAP).

Vermont Proposed Rule: 08P033

AGENCY: Dept. for Children and Families (DCF)

CONCISE SUMMARY: This rule proposes changes to implement:

  1. A premium-indexing requirement
  2. Interim coverage, pending transition between health-care programs;
  3. A new premium-assistance waiting period relating to the high-deductible exception to Catamount Health (CH) waiting period;
  4. A limitation on re-enrollment in a health-care program prior to completion of certain requirements that were unmet in a prior application attempt; and
  5. Statutory modification of the definition of "uninsured."

TYPE OF PERSONS AFFECTED: DCF's Economic Services Division, Office of Vermont Health Access, current and potential health-care program beneficiaries, and domestic-violence victims.

COST BENEFIT ANALYSIS: Revenue projections resulting from indexing beneficiary contributions to program costs were included in the Medicaid update to the Emergency Board on July 29, 2008. The specific dollar amounts associated with the remaining proposed changes are expected to be relatively insignificant.

Rule Governing the Importation and Possession of Animals for Taking by Hunting.

Vermont Proposed Rule: 08P034

AGENCY: Natural Resources, Fish & Wildlife Dept.

CONCISE SUMMARY: This rule establishes the permitting process for implementing, controlling and enforcing a rule for the importation and possession of animals for the purposes of hunting. Accordingly, this rule establishes clear criteria for the applicants who wish to operate and maintain a facility for the purposes of hunting. In addition, the rule provides for those things necessary to maintain the best health of the wild animals of the State, to prevent the introduction or spread of a disease, or parasite by imported animals that are harmful to humans and wild animals, specifically, but not exclusively, the spread of "Chronic Wasting Disease" ("CWD"), bovine tuberculosis, and rabies.

TYPE OF PERSONS AFFECTED: Applicants and putative applicants, those who currently operate such facilities, hunters, landowners, hunting equipment and supplies merchants, F&W Department personnel, travel and tourism personnel.

COST BENEFIT ANALYSIS: The economic impact will mainly be borne by those who wish to be permitted under this rule. The economic impact should be minimal, and the fencing requirements, documents associated with the health of imported animals, are necessary for the building and maintenance of such a facility, and/or are already required by the Rules of the Secretary of the Agency of Agriculture, Food and Markets. The Rule is crafted so as to minimally impact those members of the public who wish to hunt for fowl in the appropriate season. There will also be impact to the Department resources, as it will be the body that must review, inspect, and monitor any permitted facilities.

SCHEDULED HEARINGS: The Board will hold one public meeting at the Pavilion Building in Montpelier on Monday, October 20, 2008, 7 - 9 pm.
