Vermont Minimum Wage Rules

Vermont Proposed Rule: 08P031

AGENCY: Dept. of Labor

CONCISE SUMMARY: In 2007, the General Assembly passed Act 78, increasing the tip wage rate at the same percentage rate as the minimum wage. It also raised from the $30 to $120 the amount in monthly tips an employee receives to be considered a "service or tipped employee." In 2008, the General Assembly passed Act 182, allowing certain wage deductions for uniforms and required apparel. Finally, the deductions allowed for meals and lodging have been raised and set to increase annually at the same percentage rate as the minimum wage.

TYPE OF PERSONS AFFECTED: Employees, employers, and labor and employer groups such as the Vermont Labor Relations Board, Vermont Legal Aid and labor attorneys. Government agencies that may be impacted include the Department of Labor and the Department of Economic Development.

COST BENEFIT ANALYSIS: Raising the tip wage rate, as well as the tipped employment threshold, will impact employers, employees and consumers alike. The uniform deduction allowance will impact low wage workers who are generally required to provide their own uniforms, such as health care and elder care workers. However, this rule amendment primarily implements statutory mandates; the other provisions of the rule are not materially altered.

SCHEDULED HEARINGS: A public hearing via Vermont Interactive Television has been scheduled for September 23, 2008, from 5:00 p.m. to 7:00 p.m. Participating sites will be Bennington, Brattleboro, Lyndonville, Rutland, St. Albans, White River Jct., Williston, and Montpelier.
