PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Vermont Milk Commission Procedure: Development and Issuance of an Order to Establish a Retail Fluid Milk Premium, or Amendment of Such Order

AGENCY: Agriculture, Food & Markets
CONCISE SUMMARY: The Rule sets forth the Milk Commission's procedure for establishing or amending a retail fluid milk premium order, which is authorized by 6 V.S.A. §2924. The Rule also applies to other subjects or issues that require administrative process relating to the Milk Commission's establishment or amendment of an order involving a retail fluid milk premium.
TYPE OF PERSONS AFFECTED: Vermont Agency of Agriculture, Food and Markets, Vermont Milk Commission, any person, organization, or entity with an interest in a retail fluid milk premium order, including dairy farmers, dairy processors, dairy retailers, dairy food organizations, farm organizations and private, non-profit, and government entities.
COST BENEFIT ANALYSIS: This procedural Rule will have no discernable economic impact on the public or any dairy farmers, dairy product processors, retailers, or any person, organization or entity with an interest in a fluid milk premium order. The Rule will require the Milk Commission to publish public notice in newspapers of general circulation but this cost is de minimis and required by 6 V.S.A. §2929(b)(1) and the Administrative Procedures Act.

Air Pollution Control Regulations, Subchapter XI, Low Emission Vehicles
Vermont Proposed Rule: 08P030
AGENCY: Vt. Agency of Natural Resources
CONCISE SUMMARY: The Agency is proposing amendments to its Low Emission Vehicle (LEV) regulations to incorporate by reference three changes to California's LEV Program: (1) revisions to the Zero Emission Vehicle (ZEV) program to reflect technology readiness and simplify specific program requirements; (2) a new environmental performance labeling program to require labels that score smog and global warming emissions from new motor vehicles; and (3) amendments to strengthen the Emission Warranty Information Reporting and Recall requirements. Vermont first adopted California's LEV Program in 1996 and has amended its LEV regulations periodically since then to stay consistent with California. The Agency is also proposing some administrative changes to update and clarify its LEV regulations. The Agency is providing notice, comment, and a hearing on all of the proposed amendments together but may decide to adopt some or all of the proposed amendments separately.
TYPE OF PERSONS AFFECTED: Automobile consumers, including individuals, businesses, and state and local government agencies; automobile manufacturers and dealers, the Agency of Natural Resources.
COST BENEFIT ANALYSIS: Changes to the ZEV provisions are expected to reduce expense for manufacturers while encouraging consumer availability of desirable plug-in hybrid and other accessible and efficient clean vehicles. Warranty and Recall provisions are forecast to yield improved reliability and product life to consumers, which will eventually reduce warranty and recall costs for manufacturers. The economic impact of Environmental Performance label provisions will be minor for manufacturers, a potential marketing tool for dealers, and a cost-effective public education mechanism for consumers.
