By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Administrative Rules for Opticians.
Vermont Proposed Rule: 08P028
AGENCY: Secretary of State, Office of Professional Regulations
CONCISE SUMMARY: These rules reflect legislative changes including changes which moved authority over this profession from the Board of Opticians to the Director of the Office of Professional Regulation. The rules have been updated to adopt practices and procedures used by other OPR professions and to clarify licensing requirements. The revisions include many revisions to replace outdated language and make the rules easier to understand and administer. The rules update educational and license reinstatement requirements.
TYPE OF PERSONS AFFECTED: Opticians only.
COST BENEFIT ANALYSIS: These rules should have no economic impact on licensees. The only costs imposed are those attendant to reinstating licenses which have lapsed long enough to trigger the re-examination requirement.

Consumer Information and Privacy
Vermont Proposed Rule: 08P029
AGENCY: Human Services
CONCISE SUMMARY: This rule defines AHS confidentiality requirements as mandated by the law that restructured the Agency of Human Services (AHS). The AHS-wide approach is consistent with AHS' status as the Single State Agency for federal programs and a Single Covered Entity under HIPPA. This rule pertains to all Individually Identifiable Information (III) created or received by AHS, or by its contractors and grantees when they are providing services on behalf of AHS. The rule outlines the required elements of consent; defines when consent is needed before III can be disclosed, and allows for role-based, minimum necessary sharing of III without consent when necessary for AHS program administration. This rule forges a balance between the critical legal requirements of protecting consumer privacy and administering AHS programs to ensure coordination of services as well as maximum communication and collaborative planning among different specific service providers.
TYPE OF PERSONS AFFECTED: Any consumer, AHS employee, contractor, grantee, or other party that has contact with AHS and in so doing gains access to, provides, or creates on AHS' behalf individually identifiable information.
COST BENEFIT ANALYSIS: There is no specific known economic impact of this rule other than those costs that may be associated with training and compliance by all affected parties; in fact given this rule provides a single entity approach to these issues, training and compliance may be simpler and costs reduced. Information Technology compliance will be simplified as well.
