2008 Vermont Elevator Safety Rules

Vermont Proposed Rule: 08P026

AGENCY: Public Safety

CONCISE SUMMARY: The Elevator Safety Rules are being updated to include the more recent editions of the national standards regarding elevator and lift design, installation, operation and maintenance. The rules have been reorganized and consolidated to simplify use. The fee schedule for inspection of conveyances by a licensed elevator inspector varies from $100 to $250 based on the type of device, the difficulty of inspection and the frequency of use. Incidents with conveyances that involve personal injury will now need to be reported to the department. Keys for emergency operation of elevators by firefighters will now be standardized.

TYPE OF PERSONS AFFECTED: Owners of public buildings that contain elevators or lifts and licensed inspectors and mechanics are directly affected by this rule. The general public, the fire service, people with disabilities, design professionals, contractors and sub-contractors are also affected by this rule. State or municipal government entities that have buildings with conveyances are affected by this rule similar to other building owners that have conveyances.

COST BENEFIT ANALYSIS: The fee for the inspection of an elevator or lift by a licensed elevator inspector varies from $100 to $250 based on the type of device, the difficulty of inspection and the frequency of use. The higher fees reflect the difficulty in conducting an inspection, the number of people needed to conduct an inspection and the exposure to the public. The lower fees take into consideration the fewer number of stops and lack of a separate mechanical room with these devices. The technical codes and standards that are being updated by this rule are specified in statutes and have fewer requirements for existing conveyances than new conveyances. Some existing elevators will be required to change a switch key for emergency elevator control (within two years) to ensure there is no delay in the emergency operation of an elevator. The standard key selected by the Board is the less costly option and will costs approximately $450 to 500 per elevator.

Regulation Governing the Board of the Vermont State Hospital

Vermont Proposed Rule: 08P027

AGENCY: Human Services

CONCISE SUMMARY: The purpose of the proposed rule is to describe and define the scope of authority for the governance of the Vermont State Hospital (VSH), the sole public inpatient psychiatric facility in the State of Vermont. VSH, pursuant to 18 V.S.A. § 7205, is responsible for providing care for the residents of the state with major mental illness for whom no adequate less restrictive alternative can be found. VSH operates under Vermont law within the Department of Mental Health of the Agency of Human Services.

TYPE OF PERSONS AFFECTED: Agency of Human Services; Department of Mental Health; Vermont State Hospital; current VSH Governing Body; patients of the Vermont State Hospital; mental health advocates.

COST BENEFIT ANALYSIS: This rule is not expected to any economic impacts as it formalized an already existent administrative system.
