PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Communicable Disease Regulations
Vermont Proposed Rule: 08P009
AGENCY: Human Services, Department of Health
CONCISE SUMMARY: The rule is being amended to: (1) eliminate the requirement to report diseases dangerous to the public health by administrators of hospitals, health care facilities, health maintenance organizations or managed care organizations, town health officers, and nonmedical community-based organizations; (2) require reporting of identifying information pertaining to the human immunodeficiency virus (HIV); and (3) provide procedures to ensure confidentiality of all information collected and for backing up encrypted, individually identifying information, including procedures for storage, location, and transfer of data; (4) require reporting of individual cases of novel influenza A infection, and (5) update the reporting requirement for hepatitis B laboratory test results.
TYPE OF PERSONS AFFECTED: HIV positive people, medical providers, laboratories, hospitals, AIDS service organizations, Department of Health.
COST BENEFIT ANALYSIS: Costs of reporting are minimal and already established since persons and entities are already required to report diseases dangerous to the public health. There may be small costs associated short term as providers reprot updated records from previously filed reports. This cost would be minimal since the reporting structure is already in place.
