Prekindergarten Education.

Vermont Proposed Rule: 07P058

AGENCY: Dept. of Education/Board of Education

CONCISE SUMMARY: The proposed Prekindergarten Education rules are required by Act 62 of 2007. They will direct the implementation of several provisions of the law. The proposed rules will provide guidance for the following: staff qualifications; program quality requirements; financial and child progress reporting; portability; required contents of contracts between school districts and private early care and education providers; and an appeal process. The proposed rules will affect school districts which are currently offering prekindergarten education through contracts with private care and education providers and/or by operating their own classrooms. These rules also will affect school districts which elect to offer prekindergarten education in the future.

TYPE OF PERSONS AFFECTED: Families with young children, school administrators and their boards and staff, private early care and education providers, the Department of Education, and the Department for Children and Families.

COST BENEFIT ANALYSIS: Act 62 and these proposed rules do not require school districts to provide prekindergarten education. The proposed rules will apply only to those districts which opt to include three to five year old children in their average daily membership (ADM). Since Act 62 limits the number of prekindergarten children which districts can include in their ADM, there are potential implications for the tax rate of districts which serve prekindergarten children beyond their "cap". The proposed rules require greater financial and progress reporting and clarify the financial aspects of contracts which school districts may sign with private early care and education programs. The evidence from most of the districts which have entered into such contracts is that the private providers benefit financially.

SCHEDULED HEARINGS: There will be two public hearings: (1) February 11, 2008, 7:00 p.m., at Montpelier High School Library, Memorial Dr. Montpelier, VT; and (2) February 13, 2008, 3:30 p.m., at Rutland Regional Chamber of Commerce, 256 N. Main Street Rutland, VT.
