By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Fishing
Vermont Proposed Rule: 07PE02
AGENCY: Natural Resources, Fish & Wildlife Dept
.CONCISE SUMMARY: This is an amendment to existing regulation §122, Section 5, governing the taking, possessing, transporting, use and selling of baitfish. Changes include: 1) Wild baitfish cannot be personally harvested, 2) Wild baitfish can be commercially harvested from L. Champlain & only sold for use there, 3) Baitfish sold commercially elsewhere in VT must originate from fish hatcheries approved by the Commissioner. 3) Bait dealers must issue, and anglers must carry a receipt of sale from a receipt book provided by the Department containing information such as: a unique receipt number, name of Bait Dealer, time and date of sale, species and quantity purchased, waterbody where bait will be used, signature of purchaser. 4) Anglers must not leave a waterbody with baitfish in their possession. 5) Upon being removed from the water, all boats, boat trailers, boating or fishing equipment, including water in any bilge, ballast tank, bait bucket, and live well must be immediately emptied and drained of all water.
TYPE OF PERSONS AFFECTED: Wild baitfish harvesters, Commercial baitfish dealers, anglers, Vermont Fish & Wildlife
COST BENEFIT ANALYSIS: All impacts listed are POTENTIAL, not a certainty: 1) Increased cost to anglers for farm-raised live bait. 2) Loss of business to Commercial Bait Dealers (CBD's) due to higher bait costs. 3) Loss of anglers & fishing license sales due to high bait costs. 4) Increased business to DBD's as anglers cannot harvest own bait. 5) Loss of anglers & fishing license sales if VHS spreads to Vermont and causes larger fish kills and decreased fish populations, unsightly water, hemorrhaged fish.
