Vermont Prescription Monitoring System Rule

Vermont Proposed Rule: 07P047

AGENCY: Human Services, Department of Health

CONCISE SUMMARY: This rule implements the Vermont Prescription Monitoring System (VPMS) created by 18 V.S.A. Chapter 84A and establishes an electronic database and reporting system for prescriptions of Schedules II, III, and IV controlled substances to enhance opportunities for treatment and prevention of abuse of controlled substances. The rule specifies the information pharmacists are required to report to the VPMS on at least a weekly basis, including patient name and address, name and quantity of the drug dispensed, and the prescribing health care provider's name. The rule includes provisions for disclosure of system data to specified persons authorized by the statute, including a patient or the patient's provider, a provider seeking information for the purpose of providing health care to a current patient, or to a professional licensing board relating to a specific investigation of a licensee and to the commissioner of public safety when necessary to avert a serious and imminent threat to a person or the public.

TYPE OF PERSONS AFFECTED: Pharmacies and pharmacists, health care providers, patients for whom Schedule II, III, or IV controlled substances are prescribed, licensing boards of health care providers and dispensers, department of health and department of public safety.

COST BENEFIT ANALYSIS: The Vermont Prescription Monitoring System is federally funded. Pharmacies and pharmacists will incur some minor costs to implement the required reporting procedures. Pharmacies who are unable to submit their data electronically may seek a waiver from the department of health to use an alternative method of data submittal.
