Patient Safety Surveillance and Improvement System Rule
Vermont Proposed Rule: 07P036
AGENCY: Human Services, Department of Health
CONCISE SUMMARY: This rule implements the Patient Safety Surveillance and Improvement System created by 18 V.S.A. Chapter 43A for the purpose of improving patient safety, eliminating adverse events, and supporting quality improvement efforts by hospitals. The rule specifies hospital reporting requirements and establishes standards for hospital policies and procedures relating to: 1) internal reporting systems for identification, tracking and analyzing all adverse events and near misses; 2) causal analyses and corrective action plans of reportable adverse events; and 3) disclosures to patients of adverse events that result in patient death or serious bodily injury. The rule creates a formula to determine each hospital's required financial contribution to support the system, describes routine monitoring and focused compliance review procedures to ensure hospitals are in compliance with the law, and contains specific provisions relating to reporting on intentional unsafe acts.
TYPE OF PERSONS AFFECTED: Enterprises and People: All Vermont hospitals and hospital staff, including health care providers, employees and volunteers. All people receiving care and services at Vermont hospitals. Government entities: Department of Health, Office of Professional Regulation and Board of Medical Practice, Department for Children and Families, Department of Disabilities, Aging and Independent Living.
COST BENEFIT ANALYSIS: The Patient Safety and Surveillance System is supported 50% by general fund appropriations and 50% by hospitals. In addition, hospitals will incur some costs to establish and implement the policies and procedures and reporting systems required by the law. Successful implementation of the Safety System is expected to improve patient safety by reducing adverse events and near misses and those benefits are expected to outweigh the costs of the program.

Importation of Wild Birds and Animals.
Vermont Proposed Rule: 07P037
AGENCY: Natural Resources, Fish & Wildlife Dept.
CONCISE SUMMARY: The rule amends two existing regulations by combining them into one regulation. The commissioner is directed to establish and maintain two lists, a Domestic Animals List and an Unrestricted Wild Animals List. No fish and wildlife importation and possession permit is required for animals on these lists. This simplifies the process of importing animals that do not pose a risk to Vermont, its inhabitants or its wildlife resource. Wild birds and animals not on either list are unlawful to import or possess without first obtaining a permit from the Commissioner of Fish and Wildlife.
TYPE OF PERSONS AFFECTED: Pet shop merchants, animal breeders/hobbyists, Fish and Wildlife Department, VT Department of Health.
COST BENEFIT ANALYSIS: The rule amends existing regulations to establish an unrestricted List of wild birds and animals that may be imported and possessed without the owner or merchant obtaining a permit to do so. The rule clarifies those species unlawful to import and possess without first obtaining a permit from the commissioner. The possession and sale of a number of species requiring a permit by animal breeders, hobbyists, and pet store merchants will be reduced.
