PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Vermont Water Quality Standards Amendment (LDA and Turbidity)

Vermont Proposed Rule: 07P035

AGENCY: Vermont Natural Resources Board, Water Resources Panel

CONCISE SUMMARY: The proposed Vermont Water Quality Standards (VWQS) amendments (a) formally deleted the Limited Duration Activities provision that was invalidated when the U.S. Environmental Protection Agency (EPA) issued a disapproval letter on June 11, 2007; and (b) revise the turbidity standards to apply as annual averages during dry weather base flow conditions, and otherwise prohibit amounts or concentrations that would prevent the full support of uses.

TYPE OF PERSONS AFFECTED: Developers, environmental groups, citizens and citizen groups, lawyers, engineers, architects, consultants, state and local officials and all persons and governmental agencies who apply for discharge permits or who have a particularized interest that may be affected by discharge permits.

COST BENEFIT ANALYSIS: It is not anticipated that these proposed rules will have any direct or indirect negative economic impact. The federal government's invalidation of the LDA provision would likely have a significant adverse economic impact without the proposed turbidity standard revisions, because the VWQS would lack flexibility to allow permitting in some situations.
