Vermont Criminal Justice Training Council Rules & Regulations

Vermont Proposed Rule: 07P027

AGENCY: Vermont Criminal Justice Training Council

CONCISE SUMMARY: The intent is to bring the Criminal Justice Training Council into compliance with the requirements of Title 20 V.S.A. § 2355. This section mandates rules, some of which do not currently exist. The proposed rules will strike all current rules and replace them in their entirety. This also modifies the rules, last reviewed and revised in 1991, to mirror current practice. Two new rules have been added to address canine training and decertification.

TYPE OF PERSONS AFFECTED: Law enforcement agencies and certified law enforcement officers.

COST BENEFIT ANALYSIS: There is no economic impact intended or anticipated. This process brings rules current with practice. It does NOT mandate a change in the number of training hours required.

SCHEDULED HEARINGS: No public hearing scheduled at this time.

Child Support Guidelines

Vermont Proposed Rule: 07P028

AGENCY: Human Services, Office of Child Support

CONCISE SUMMARY: This rule revises the three tables used to calculate child support. These include the two tables for converting gross income to available income (called the Tax Conversion Tables), and the Intact Family Expenditures Tables which estimates a family's expenditures on children. The proposed Gross to After Tax Income Tables consider the 2007 federal and State tax rates. The Intact Family Expenditure Table has been revised to reflect the most recently available detailed information on household expenditures by using economic estimates measured in 2006 by Dr. David Betson, Professor of Economics, University of Notre Dame.

TYPE OF PERSONS AFFECTED: Children of separated parents; custodial parents; non-custodial parents; Family court Magistrates, Case Managers and Judges; Office of Child Support staff; and attorneys involved in child support cases.

COST BENEFIT ANALYSIS: The economic impact of this revision is not significant. Changes in the tax tables in the amounts allowed for personal exemptions and standard deductions generally produce a higher after tax income. The intact family expenditures table bears varying results depending on the monthly combined available income of the parents and the number of children. The amounts under the proposed Table of Intact Family Expenditures have increased at all levels besides the lower and higher income levels of cases with one child. In these cases, there was a slight decrease in expenditures. In one child cases, the proportion of the obligor's income payable in child support is roughly the same as the 2004 tables. In cases with two or more children, the proportion of obligor's income payable in child support is slightly higher than in the 2004 tables. In test cases, the range of increase was anywhere from a tenths of a percent to just over three percent.
