By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Special Education Regulations

Vermont Proposed Rule: 07P009

AGENCY: Dept. of Education/Board of Education

CONCISE SUMMARY: The majority of the changes in the proposed rules are adjustments to the VT rules adopted on August 24, 2006. The proposed rule changes implement the final regulatory requirements of IDEA that went into effect on October 24, 2006. The changes in the proposed rules clarify requirements, add detail from the new federal regulations or correct areas where our rules did not follow the new federal regulations. Several definitions were rewritten to improve clarity. Four areas of substantive changes: 1) Federal requirement for parent consent each time access to public benefits or insurance is sought; 2) Proposed language to allow local education agencies to use a "response to instruction" model for identification of students with specific learning disabilities rather than a discrepancy model; 3) Proposed rule changes to the administrative complaint rule to clarify practice consistent with federal law; and 4) Proposed rule change regarding instructional costs which substitutes co-teaching for core staff.

TYPE OF PERSONS AFFECTED: Parents, teachers, public and private school administrators and their boards; homeschoolers; and the Department of Education and those agencies with which it shares students in state custody. Special Education advocates; Vermont Disability Law Project; attorneys practicing in the areas of education and special education.

COST BENEFIT ANALYSIS: The two areas of the proposed rules with potential cost implications are the changes to identification requirements for students with specific learning disabilities and the proposal to allow co-teaching as a reimbursable use of a special education teacher's time instead of allowing core staff. In both of these instances the changes are seen as changing the way funds are spent rather than increasing costs.
