Interconnection Procedures for Proposed Electric Generation Resources (Rule 5.500).

Vermont Proposed Rule: 06P007 

AGENCY: Public Service Board 

CONCISE SUMMARY: This rule provides a standard procedure for the interconnection of distributed electrical generation with electric utilities. 

TYPE OF PERSONS AFFECTED: Developers of proposed distributed generation (other than those subject to the jurisdiction of  PSB  Rule 5.100 or subject to federal jurisdiction) and all Vermont electric utilities with which the proposed distributed generation would interconnect.  The Vermont Department of Public Service might also be affected in that it is a party to all Public Service Board cases. 

COST BENEFIT ANALYSIS: This rule should not result in a negative economic impact to developers of distributed generation or to electric utilities.  Section 7 of Act 61 requires that "the public service board shall establish by rule or order standard provision, including applicable fees that are required to cover the total cost of interconnection to be paid by the qualified distributed generator, for agreements providing for interconnection between the facilities of a retail electricity provider under the jurisdiction of the board and the facilities of a qualified distributed generator." This rule provides a standard procedure for the payment of the above-mentioned fees, which reimburse the interconnecting electric utility for its costs.  In addition, this rule may result in an economic benefit to developers of electric generation and to utilities because it is intended to provide a predictable, understandable, and efficient procedure for interconnecting distributed generators with electric utilities. 

SCHEDULED HEARINGS: A public hearing will be held at 10:00 a.m. on Tuesday, April 11, 2006, in the Public Service Board's Hearing Room, 3rd Floor, Chittenden Bank building, 112 State Street, Montpelier, Vermont.

Sustainably Priced Energy Enterprise Development Program (Rule 4.300)

Vermont Proposed Rule: 06P008 

AGENCY: Public Service Board 

CONCISE SUMMARY: The proposed rule is designed to encourage the development of renewable energy projects in Vermont by providing a mechanism for Vermont's electric utilities to acquire long-term contracts with such generating sources. 

TYPE OF PERSONS AFFECTED: Electric distribution utilities, developers of renewable energy projects, Department of Public Service, Agency of Natural Resources, and ratepayers. 

COST BENEFIT ANALYSIS: The proposed rule is designed to encourage Vermont's electric utilities to purchase in-state renewable power. To the extent that the Vermont utilities purchase renewable power through long-term contracts, Vermont ratepayers will see some increased stabilization of electricity rates as the Vermont utilities' rates are largely influenced by the market price for electricity, which is largely influenced by price fluctuations in natural gas prices.

Solid Waste Management Rules

Vermont Proposed Rule: 05P043 

AGENCY: Vt. Agency of Natural Resources  

CONCISE SUMMARY: Amends regulations relating to management of earth materials and mining waste. Amends the definition of "discarded" and provides for limited exemptions regarding disposal of animal carcasses.  Minor changes to interim certification, amendment, and revocation sections of the rule. Categorical certification requirements amended to include additional eligible wastes and legislative changes. 

TYPE OF PERSONS AFFECTED: Mining industry, solid waste facilities, environmental organizations, Vermont residents living near a mining or mineral processing facility, farmers disposing of animal carcasses, Department of Fish and Wildlife, and Agency of Agriculture Food and Markets.  

COST BENEFIT ANALYSIS:  Economic impact to those persons in the mining industry that generate mining waste from beneficiation or addition of chemicals during processing.Costs are associated with permitting, construction, operation and monitoring of those facilities. Costs will depend on the nature of the beneficiation or chemical additives, the volume of the waste produced, and how the waste is managed.
