By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Advance Directives for Health Care Rules.
Vermont Proposed Rule: 06P005
AGENCY: Human Services, Department of Health
CONCISE SUMMARY: This rule provides an optional form of an advance directive with an accompanying explanatory form, clinician orders for life sustaining treatment, use of experimental treatments, a model Do Not Resuscitate (DNR) order, DNR identification, revocation of DNR identification, and emergency medical standards for DNR orders and advance directives. The proposed rule may be viewed at the department of health's website: http://www.healthyvermonters.info.
TYPE OF PERSONS AFFECTED: This rule will affect health care facilities, health care providers, residential care facilities, emergency medical services providers, the department of health, the department of motor vehicles, persons who wish to create advance directives and Do Not Resuscitate (DNR) orders (and their families or next of kin) and entities working with such persons (such as the Vermont Ethics Network), attorneys, judges, the Legal Aid Society, funeral directors, organ procurement organizations, the Office of Vermont Health Access (OVHA), the probate courts, crematory operators, and cemetery officials.
COST BENEFIT ANALYSIS: This rule will save health care costs by providing important information to guide health care providers to make and implement treatment decisions, by reducing the need for formal court adjudications of treatment, and by decreasing the costs associated with unwanted and possibly unnecessary care. Implementation of the rule will increase costs for the department of health because of the development and maintenance of an advance directive registry by the department.
