PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Correctional Field Staff Caseload Capacity.
Vermont Proposed Rule: 06P004
AGENCY: Human Services, Dept. of Corrections
CONCISE SUMMARY: This rule establishes the guidelines under which the Department of Corrections will determine whether it has a sufficient number of trained correctional field staff, the actions it will take to manage caseloads which include offenders released from incarceration, and the process it will use to request additional staff resources. (The proposed rule can be accessed at Corrections' Web site: www.doc.state.vt.us.)
TYPE OF PERSONS AFFECTED: All DOC staff and contractors; Corrections Joint Legislative Oversight Committee; Department of Public Safety, State's Attorneys and Sheriffs' Association; the Judiciary; the Defender General, Prisoners' Rights Office, VT Protection & Advocacy, offender advocates; Center for Crime Victim Services, Network Against Domestic and Sexual Violence; Corrections' Advisory Board; business owners; community-based organizations providing services to offenders; and offenders and their families.
COST BENEFIT ANALYSIS: It is anticipated that personnel costs needed to address the caseloads which include offenders released from incarceration statewide will be managed within the DOC budget. Currently, the department does not anticipate any fiscal impact. However, external factors such as crime rate, sentencing practices, offender profiles and/or non-compliance with conditions could influence caseloads which include offenders released from incarceration in such a way as to require increases in staff, resulting in substantial new unbudgeted costs. Each probation or community correctional officer costs approximately $53,000 per FTE per year.
SCHEDULED HEARINGS: Two public hearings have been scheduled: March 13, 2006 at Hotel Coolidge, 39 S. Main St., White River Junction, 5-7 pm, and March 14, 2006 at the Dept. of Corrections' Burlington Probation & Parole Office, 50 Cherry Street, Burlington, 5-7 pm.
