By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Special Education Regulations

Vermont Proposed Rule: 06P002 

AGENCY: Dept. of Education/Board of Education 

CONCISE SUMMARY: The rule changes implement the re-authorized federal Individuals with Disabilities Education Improvement Act (IDEIA) of 2004. The rules affect public school special education in Vermont funded with federal IDEIA money.  

TYPE OF PERSONS AFFECTED: Parents, teachers, public and private school administrators and their boards; homeschoolers; and the Department of Education and those agencies with which it shares students in state custody. Special Education advocates; Vermont Legal Aid; Attorneys practicing in the areas of education and special education; higher education program personnel associated with special education training programs.

COST BENEFIT ANALYSIS: Potential increased costs to school districts in the following: evaluating children in private schools; special education teachers and para-educators must meet state license standards; children in grades 1-3 who are not reading at grade level may be provided with prescribed instruction to reduce need for special education in grade 4 onward. Potential cost reduction in the following: less requirements for cognitive testing; limitation on number or re-evaluations in a single year; reduced number of triennial evaluations; parental rights mandated only once per year and may be made available on-line; addition of resolution sessions and other changes to the due process system; manifestation determination review procedures are simplified to facilitate decision-making; authority given to school personnel to remove special education students to alternative educational settings without having to request a hearing officer review. Additional groups or entities that will be impacted by the cost implications associated with the rule changes include parents, teachers, public and private school administrators and their boards; homeschoolers; and the Department of Education and those agencies with which it shares students in state custody. In addition, Vermont Legal Aid, UVM, Vermont State Colleges, Vermont's Agency of Human Services. 

SCHEDULED HEARINGS: A Public Hearing is presently scheduled for March 27, 2006 from 4:15 PM to 8:30 PM. This hearing will be presented through Vermont Interactive Television (VIT). VIT sites will be available in Bennington, Castleton, Johnson, Lyndonville, Middlebury, Randolph Center, Rutland, Springfield, St. Albans and Waterbury. As needed, sign language interpreters will be available.
