PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Restitution Unit Rules Administrative Rules Governing the Crime Victim's Restitution Special Fund and Related Policies

Vermont Proposed Rule: 05P051 

AGENCY: Vermont Victim's Compensation Board / Restitution Unit 

CONCISE SUMMARY: The purposes of these Rules is to govern: advance payment of restitution from the Crime Victims' Restitution Special Fund, investigations of and adjustments to the amount of restitution ordered, donations to the Crime Victims' Restitution Special Fund, approval of Victim Service Agencies, determinations of acts and actors involved in a Crime Spree, setoff procedures employed by the Restitution Unit, and the appeals of determinations made by the Restitution Unit by those aggrieved. 

TYPE OF PERSONS AFFECTED: These Rules primarily affect criminal offenders ordered to pay restitution and victims of crime entitled to receive restitution, under 13 V.S.A. § 7043.  In addition, the Vermont Department of Taxes, Vermont Lottery Commission, Vermont Department of Corrections, the Vermont Department of Prevention, Assistance, Transition, and Health Access, State's Attorneys, the Attorney General, the Defender General and public defenders will be marginally affected by the Rules. 

COST BENEFIT ANALYSIS: Victims that are owed restitution, as well as criminal offenders that owe restitution, will be effected when the Restitution Unit uses its setoff authority to intercept monies owed by the State of Vermont to offenders and subsequently remit the amount intercepted to the victims who are owed restitution. 

SCHEDULED HEARINGS: 2:00 p.m. - 4:00 p.m., Wednesday, November 23, 2005, in the Mad Tom Notch Room at the Cyprian Learning Center, (State Complex Osgood Building) Waterbury, VT. 

DEADLINE FOR PUBLIC COMMENT: December 2, 2005.
