PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Regulated Drug Rules
Vermont Proposed Rule: 05P048
AGENCY: Human Services, Department of Health
CONCISE SUMMARY: Adds buprenorphine to the Regulated Drugs Rule, thus making the unlawful possession and distribution of buprenorphine a State crime. Buprenorphine is an opioid partial agonist which was approved by the Food and Drug Administration (FDA) for the use in opioid addiction treatment in October, 2002. Because of its opioid agonist effects, buprenorphine is abusable, particularly by individuals who are not physically addicted to opioids. Unlawful possession and distribution of buprenorphine is a Federal crime.
TYPE OF PERSONS AFFECTED: Law enforcement entities such as State's Attorneys and police officers, District Courts, criminal defense attorneys, and the Defender General's Office are potentially affected. Vermont State's Attorney's Offices have reported a couple of occasions in which individuals have possessed buprenorphine without having received a prescription for the drug. They cannot currently prosecute under State law.
COST BENEFIT ANALYSIS: Vermont State's Attorney's Offices have reported a couple of occasions in which individuals have possessed buprenorphine without having received a prescription for the drug. Since the number of occasions has been small, the economic impact of adding buprenorphine to the Regulated Drugs Rule is expected to be insignificant.
