Changes to SSI - related Medicaid Pursuant to Act 56 (H.543)(2005)

Vermont Proposed Rule: 05P029

AGENCY: Dept. for Children and Families (DCF)

CONCISE SUMMARY: These rule changes update SSI-related Medicaid regulations to conform to changes brought about by Choices for Care, a major reform of the Vermont long term care system under a waiver administered by the Department for Disabilities, Aging, and Independent Living, authorized by Social Security Act Section 1115. These rule changes also expand the income and resource disregards to enable more individuals who are disabled and working to qualify for Medicaid coverage, pursuant to Act 56, § 4. Lastly, technical rule changes are proposed to clarify existing rules, incorporate interpretive memoranda, and include another option for individuals with annuities who seek SSI-related Medicaid coverage.

TYPE OF PERSONS AFFECTED: Aged, blind, or disabled Medicaid applicants and their advocates; long-term care service providers including nursing homes and home health agencies; Vermont Department for Children and Families (DCF), Vermont Department of Disabilities, Aging & Independent Living (DAIL), Office of Vermont Health Access (OVHA).

COST BENEFIT ANALYSIS: The regulatory changes are expected to be essentially cost-neutral, with a fiscal impact of approximately $0. With respect to the changes concerning working people with disabilities, we expect minor savings from the new work-evidence requirement to be offset by minor expenditure increases from the unearned-income limit changes.

SCHEDULED HEARINGS: Monday, August 8, 2005, 10a.m., in the Agency of Human Services' Blue Room, DCF, State Office Complex Waterbury, Vermont.

Choices for Care (1115 Long-Term Care Medicaid Waiver) Regulations

Vermont Proposed Rule: 05P030

AGENCY: Human Services, Dept. of Disabilities, Aging and Independent Living

CONCISE SUMMARY: These regulations implement the "Choices for Care" long-term care Medicaid Wavier (1115) program. This program provides long-term care services to Medicaid eligible Vermont elderly citizens or physically disabled adults in a choice of settings.

TYPE OF PERSONS AFFECTED: All Medicaid eligible Vermonters in need of long-term care and their families, advocates for the elderly and physically disabled, Long-term Care Ombudsmen, nursing homes, residential care homes, assisted living facilities, adult day programs, Area Agencies on Aging, Home health Agencies, Agency of Human Services.

COST BENEFIT ANALYSIS: This rule will not change Medicaid expenditures, or revenues, significantly. It is expected that with the array of options to the program participants, the balance of Medicaid income and expenditures will shift from nursing homes to community providers.
