Medicare Supplement Insurance Minimum Standards Regulation, Regulation H-2005-02

Vermont Proposed Rule: 05P018

AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration

CONCISE SUMMARY: The law will implement the changes to the Medicare Supplement standardization scheme effected by the federal Medicare Modernization and Prescription Drug Act of 2003. In addition, it updates Vermont's rule to make it consistent with the NAIC model rule.

TYPE OF PERSONS AFFECTED: Elderly or disabled individuals who have or may buy Medicare Supplement insurance policies, Medicare Supplement insurers, BISHCA.

COST BENEFIT ANALYSIS: The two new cost sharing plans (K and L) may result in greater sales for insurers and greater savings for purchasers. The ability to keep a Medicare Supplement plan that previously had prescription drug coverage, while receiving prescription drug benefits under Medicare Part D, may result in savings for some insureds. Review of filings for removal of prescription drug coverage and new plans will result in significant, one-time, increased staff and resource use by the Health Care Administration.
