Rental Housing Health Code

Vermont Proposed Rule: 05P014

AGENCY: Human Services, Department of Health

CONCISE SUMMARY: This rule amends the existing Rental Housing Health Code to address inadequacies in meeting current rental health and habitability standards as well as confront overlap between the Code and the VT Fire Prevention and Building Code and the Electrical Safety Rules. The rule amends the text of the current Code to clarify the standards for the rental of mobile home lots not located in a mobile home park, and more clearly address moisture problems and other habitability issues such as water supply and ventilation.

TYPE OF PERSONS AFFECTED: The Department of Health, the Department of Labor and Industry, Town Health Officers/Local Boards of Health, Landlords, Tenants and Tenants Rights Groups, VT State Housing Authority and other independent housing authorities, VT Legal Aid.

COST BENEFIT ANALYSIS: The Agency expects the amendments to the rule to have positive benefits by assuring that rental properties meet current minimum health and habitability standards and that the overlap between this rule and other rental housing laws and regulations is addressed. The changes in this rule may result in an economic impact to landlords that may be passed onto their tenants due to new standards such as the mandate of screens on operable windows, and requirements for the rental of mobile home lots and ventilation. However, it is unlikely that the economic impact will be significant because the changes are not considerable and many of the proposed changes are items that are addressed by town health officers through interpretation of the current rule. This rule will not impose additional costs on town health officers and local boards of health as they have been responsible for the enforcement of the current Code since 1974 and the rule does not include changes affecting their authority.

Administrative Rule for Respiratory Care Practitioners

Vermont Proposed Rule: 05P015

AGENCY: Secretary of State, Office of Professional Regulations

CONCISE SUMMARY: These are the initial rules governing the newly licensed profession of respiratory care. The statute is quite explicit so the rules are relatively simple, explaining application, renewal and disciplinary procedures of the office of professional regulation and continuing education requirements.

TYPE OF PERSONS AFFECTED: Respiratory care practitioners, applicants for licensure, consumers of respiratory care services, employers of respiratory care practitioners such as hospitals and health care clinics, and the Office of Professional Regulation.

COST BENEFIT ANALYSIS: Respiratory care practitioners will see a minor impact due to application and fees. There will be a beneficial impact upon the profession and the public in that the rules will help ensure competent practitioners and provide a means of recourse when the public is harmed.

Powerball Rule Changes Effective August 28, 2005.

Vermont Proposed Rule: 05P016

AGENCY: Vermont Lottery Commission

CONCISE SUMMARY: The effects of the rule changes are as follows:

  1. To increase the average jackpot size, the white ball matrix is changed from five (5) out of fifty-three (53) numbers to five (5) out of fifty-five (55) numbers. This changes the jackpot odds to 1 in 146.1 million. the current game has jackpot odds of 1 in 120.5 million. The overall odds of winning a cash prize will remain virtually the same at 1 in 36.60 (up slightly from 1 in 36.06).
  2. The starting jackpot of $10 million is changed to $15 million and will increase by no less than $5 million.
  3. The annuity option will be changed so that players will receive an annual payment that increases each year. Players can also still elect to receive the jackpot as a lump-sum cash payment.
  4. The second prize for matching five white ball numbers is doubled from $100,000 to $200,000.

TYPE OF PERSONS AFFECTED: The affected parties include Lottery Players, licensed retailer agents, Vermont Lottery Commission, and The State of Vermont Education Fund.

COST BENEFIT ANALYSIS: The economic impact is that the Vermont Lottery would contribute significantly more money each year to the Vermont Education Fund. In the first year of Powerball sales the Vermont Lottery contributed an additional $3.3 million to the Education Fund from the prior year.
