Vermont Water Quality Standards - 2004 Proposed Amendments.

AGENCY: Vermont Water Resources Board
CONCISE SUMMARY: The proposed rules consist of amendments to the Vermont Water Quality Standards, eff. July 2, 2000 (VWQS), petitioned by the Secretary of the Agency of Natural Resources (ANR), specifically: (1) to amend Section 4-08(A) to reclassify from Class A2 to Class B waters of a certain unnamed tributary in the Lower Winooski River at Pinewood Manor in the Town of Essex, Vermont (Part of Basin 8); and (2) to amend Section 4-09 to amend a classification and establish Water Management Type (WMT) designations for public waters within the White River Basin (Basin 9), pursuant to Section 3-06. There also are several minor amendments to correct format and typographical errors in the VWQS.
TYPE OF PERSONS AFFECTED: The people, enterprises and government entities that will be affected by the proposed rules are potentially many. With respect to the proposed VWQS amendments related to the unnamed tributary of the Lower Winooski River (Basin 8), those affected include the developer and residents of Pinewood Manor, Inc.; the Town of Essex; and ANR. With respect to the proposed VWQS amendments related to the White River Basin (Basin 9), these include all riparian property owners; individuals who use or otherwise enjoy these waters for recreational uses; commercial enterprises using or having an impact on these waters, including those engaged in agriculture, forestry, water withdrawals, electrical generation through hydro power, and water-based recreational tourism; municipalities using the waters for municipal waste disposal and water supplies; State agencies, including ANR, Transportation, and Agriculture, Food and Markets; and the federal government as owner and manager of the National Forest within Basin 9.
COST BENEFIT ANALYSIS: The economic impact of the proposed rule amendments is described in more detail in the attached Economic Impact Statement. The proposed amendment to reclassify the unnamed tributary to the Lower Winooski River from Class A2 to Class B will have a positive economic impact on the developer of Pinewood Manor, Inc., and no foreseeable adverse economic impact upon either the present or future residents of Pinewood Manor, Inc., or the Town of Essex. The classification change and water management types proposed for the White River Basin describe present water quality conditions and management goals and will not result in any significant economic burden upon any class of persons, entities, or governmental agencies listed above.
SCHEDULED HEARINGS: Hearings with respect to the proposed VWQS amendments for the White River Basin (Basin 9) will be held on February 22, 2005, at 3:00 p.m. at St. John's Church, 15 Summer Street, Randolph, Vermont, and on February 22, 2005, at 7:00 p.m., in the Vermont Room, the Hotel Coolidge, 39 South Main Street, White River Junction, Vermont. A hearing with respect to the proposed VWQS amendment for the unnamed tributary of the Lower Winooski River (Basin 8) will be held on March 3, 2005, at 3:00 p.m. in the Large Conference Room, ANR / District Fish and Wildlife Building, 111 West Street, Essex Junction, Vermont.

Stormwater Management Rule
Vermont Proposed Rule: 05P004
AGENCY: Natural Resources, Environmental Conservation
CONCISE SUMMARY: This Rule is being issued to clarify the requirements for the management of Stormwater runoff. The Rule will apply statewide, except in those waters listed as principally impaired due to stormwater runoff on the EPA-approved State of Vermont 303(d) List of Water. The management of stormwater runoff within stormwater-impaired waters is currently managed in accordance with 10 V.S.A. §1264 and 1264a, and will be the subject of a subsequent stormwater rule. This Rule establishes a permitting program, including permitting thresholds and treatment standards, for new development, existing development, redevelopment and the expansion of impervious surfaces. In general, the creation of one or more acres of impervious surfaces requires a permit. This Rule provides for the issuance of individual and general permits. In addition, this Rule amends the Vermont Stormwater Management Manual dated April 2002.
TYPE OF PERSONS AFFECTED: Individuals and private or public entities that develop, redevelop or expand over one acre of impervious surfaces are required to obtain a stormwater permit under this Rule. In addition an individual or entity that currently owns property that was previously issued a stormwater discharge permit by the Agency is subject to this Rule.
COST BENEFIT ANALYSIS: This Rule lowers the permitting threshold from two acres to one acre of impervious surface. DEC estimates that annually approximately thirty additional individuals, private and public entities will be subject to this Rule. DEC estimates that it will cost approximately $30,000 per acre of impervious surface for new development, redevelopment and expansions to meet the treatment standards in the Rule.
SCHEDULED HEARINGS: March 7, 2005, St. Albans Town Educational Center; March 10, 2005, Rutland Free Library; March 14, 2005; VT Veterans Home, Bennington; March 16, 2005, Burlington City Hall; March 23, 2005, Pavilion Auditorium, Montpelier. All public hearings will be held at 3:30 pm and 6:30 pm.
