2005 Deer Management Rule, Fish and Wildlife Regulation # 1502.

Vermont Proposed Rule: 05P001 

AGENCY: Natural Resources, Fish & Wildlife Dept. 

CONCISE SUMMARY: This rule is the successor to the temporary rule on Deer Management that sunsets on December 18, 2004.  It defines a legal deer, sets a state wide limit of one buck per year, sets an annual limit on deer, establishes bow and arrow and muzzleloader seasons and establishes a test program on antler restrictions in Wildlife Management Units (WMU's) B, J1 and K2.  It consolidates the regulation of youth deer hunting with the general regulation of deer hunting.

TYPE OF PERSONS AFFECTED: Hunter, landowners, sporting goods stores, general stores, gas stations, restaurants, motels, hunting guides, people who view wildlife and law enforcement agencies. 

COST BENEFIT ANALYSIS:  Based on 2001 data provided to the U.S. Fish and Wildlife Service, the positive economic impact to Vermont from deer hunting from retail sales, wages, excise and state and federal income taxes was in excess of $50,000,00. In 2003, F&W issued over 90,000 hunting licenses, account for over $3,000,000 in license income.  Failure to provide for these deer seasons could be devastating. Commercial activities who depend on deer hunters for income would not get any. Local overpopulations of deer could adversely impact farmers, orchards and homeowners.  License sales would drop off, limiting Fish and Wildlife's ability to fund programs.  The one buck limits and test programs are expected to lower license sales with corresponding indirect effects on the economy. Fish and Wildlife will track income changes for planning and program purposes.

Workers' Compensation Vocational Rehabilitation Rules

Vermont Proposed Rule: 05P002  

AGENCY: Labor & Industry  

CONCISE SUMMARY: Act 132 eliminated mandatory vocational rehabilitation (VR) and in its place provided for mandatory notification of workers disabled 90 days, notice of employee rights, screening and solicitation of information to assess VR entitlement.  Rule revision extended to one portion of the rules improperly assigned in the past.  This rule revision accomplishes two purposes:  1.  Revisions necessitated by Act 132. Specifically, provides for establishment of a notice and screening mechanism for injured workers' with regard to eligibility for vocational rehabilitation; and provides for more identifiable goals for the vocational rehabilitation process; and provides for a vocational rehabilitation fee schedule.  2.  Elimination of medical case management certification from vocational rehabilitation section of rules due to notification from Board of Nursing of error in workers' compensation certification of professionals in nursing. 

TYPE OF PERSONS AFFECTED: Employees and employers, insurance carriers and their agents, attorneys, vocational rehabilitation providers, and interest groups representing labor, business and insurance interests.  Interested groups include the AFL/CIO, VSEA, VTLA, the State of Vermont Risk Management Division,  VLCT, AIA and other interest groups.  

COST BENEFIT ANALYSIS: This rule is expected to have minimal economic impact, overall, however, it is anticipated that the vocational rehabilitation dollars spent will be better utilized; with more dollars spent on injured workers who need vocational rehabilitation benefits and services and less money spent on VR services for workers who possess the ability to return to suitable work.
