PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Vermont Endangered and Threatened Species List
Vermont Proposed Rule: 04P044
AGENCY: Natural Resources, Fish & Wildlife Dept.
CONCISE SUMMARY: This rule amends the present Endangered and Threatened Species Rule. The status of four species would change from endangered to not listed (Many-leaved Sedge, Osprey, Common Loon and Peregrine Falcon), two species would change from threatened to endangered status (Upland Sandpiper and Black Tern), two species not currently listed would become listed as threatened (Eastern Ratsnake and Eastern Racer), and two other species not currently listed would become listed as endangered (Dwarf Chinkapin Oak and Pygmy Water-lily). In summary four species would no longer be listed, four species would be newly listed and two species already listed would have their status changed.
TYPE OF PERSONS AFFECTED: Natural resources managers, planners, municipalities, landowners, developers, and people interested in Vermont's natural heritage.
COST BENEFIT ANALYSIS: Species added to the list may require additional monitoring, management, and regulatory review, but this is not anticipated to represent a major change from current activities. Landowners and developers may need to modify plans to avoid impacts, or mitigate for impacts, if listed species are likely to be affected. Few, if any, development proposals should require significant changes due to listed species because these species are seldom encountered due to their rarity. Funds may be needed to develop conservation programs to recover listed species. Delisting species may decrease expenses to landowners and developers. Monitoring and appropriate management of delisted species will need to continue to ensure the conservation of the species.

Administrative Rules for Athletic Trainers.
Vermont Proposed Rule: 04P045
AGENCY: Secretary of State, Office of Professional Regulations
CONCISE SUMMARY: This is a revision of the rules that govern the licensing of athletic trainers. The revisions are mostly in response to the legislative change from certification to licensure. Additionally, the Director, with the advice of the athletic trainer advisors, has promulgated rules regarding temporary permits.
TYPE OF PERSONS AFFECTED: Athletic trainers, applicants for licensure, consumer of athletic training services, employers of athletic trainers such as high schools, universities, colleges, professional athletic teams, clinics, hospitals and the Office of Professional Regulation.
COST BENEFIT ANALYSIS: No economic impact is expected.

Sex Offender Registry - DOC Directive 255.01
Vermont Proposed Rule: 04P046
AGENCY: Human Services, Dept. of Corrections
CONCISE SUMMARY: This rules establishes the process for determining high risk and non-compliance status of sex offenders for purposes of the Internet Sex Offender Registry.
TYPE OF PERSONS AFFECTED: Offenders convicted of sexual crimes, members of the Department of Public Safety, the Department of Corrections, crime victims, law enforcement, the Judiciary, State Attorneys.
COST BENEFIT ANALYSIS: Minimal operational costs.
