PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Charitable Solicitations -- Consumer Fraud Rule (CF)119 (Revised).

Vermont Proposed Rule: 04P042 

AGENCY: Attorney General's Office

CONCISE SUMMARY: The Attorney General's Office proposes to revise existing CF 119 to require electronic filing of paid fundraiser forms (as authorized by a recent statutory amendment); conform fundraising disclosures to recent statutory amendments; clarify the meaning of the term fundraising "solicitation"; add several categories of information to be disclosed in the fundraiser's notice of solicitation and financial report; and reword CF 119 for reasons of style and clarity. 

TYPE OF PERSONS AFFECTED: Paid fundraisers for charities. 

COST BENEFIT ANALYSIS: Instead of filing notices of solicitation and financial reports in hard copy, paid fundraisers will do so online.  With a computer and modem, any fundraiser will be able to do this easily. Moreover, given the fact that the current paper forms are customized to Vermont, and that the rule permits the filing of electronic attachments for those categories of information that are most lengthy, online filing should in general not take longer than paper filing.
