Wastewater System and Potable Water Supply Rules
Vermont Proposed Rule: 04P031
AGENCY: Vt. Agency of Natural Resources
CONCISE SUMMARY: The proposed revisions allow for delegation of the Wastewater System and Potable Water Supply Rules to municipalities, extends site technician authority, updates grease trap requirements, adds an exemption grandfathering existing municipal septic system permits, adds an amnesty provision for illegal construction of a second residence on a property prior to January 1, 1999, revises technical standards for separation between the bottom of the disposal system and the seasonal high water table in limited circumstances, and adds a provision for systems that store wastewater during periods of high seasonal water table and doses the leach field during dry periods.
TYPE OF PERSONS AFFECTED: Property owners, engineers, and site technicians. Municipalities may be affected by changes allowing development in areas not previously approvable.
COST BENEFIT ANALYSIS: there should be no negative impacts, other than the possibility that a delegated municipality will set their application fees at a higher rate than the state fees. There should be a limited positive impact as previously unapprovable lots become approvable. The grease trap revisions will reduce the cost of compliance for projects connected to municipal wastewater treatment facilities.

Savings Bond Changes mandated by Act 122 (2004), Making Appropriations for the Support of Government.
Vermont Proposed Rule: 04P032
AGENCY: Dept. of Prevention, Assistance, Transition, and Health Access (PATH)
CONCISE SUMMARY: United States savings bonds will be treated as an available resource beginning on the date of purchase unless aged, blind and disabled individuals seeking SSI-related Medicaid coverage have requested and been denied a hardship waiver from the United States Department of the Treasury, Bureau of Public Debt.
TYPE OF PERSONS AFFECTED: Aged, blind, or disabled Medicaid applicants and their advocates.
COST BENEFIT ANALYSIS: Over the past two years, the department is aware of long-term care Medicaid applicants sheltering an estimated 3 million dollars of their resources in United States savings bonds. The department will not recoup assets currently rendered unavailable because they are in their minimum retention period. However, this rule change will preclude further use of this Medicaid planning technique. The new rule considers savings bonds as an available asset during their 12 month minimum retention period, unless individuals have requested a hardship waiver based on financial need for their medical expenses and been denied.

Fuel Program Changes.
Vermont Proposed Rule: 04P033
AGENCY: Dept. of Prevention, Assistance, Transition, and Health Access (PATH)
CONCISE SUMMARY: The rule proposes to increase the dollar amounts in the Standard Heating Cost Tables for all fuel types.
TYPE OF PERSONS AFFECTED: Applicants for and recipients of seasonal fuel assistance benefits, suppliers of heating fuel, and the Department for Children and Families. Other groups may include community-based organizations such as Area Agencies on Aging, Weatherization Offices, Community Action Agencies, and the Department of Aging and Independent Living, whose client groups will be affected.
COST BENEFIT ANALYSIS: The changes proposed within this rule will be accommodated with the annual Low-Income Home Energy Assistance Program (LIHEAP) allocation for Vermont. This change will have the greatest impact on the Vermonters with the lowest income by potentially increasing their season fuel assistance benefits.
