PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Environmental Protection Rules Chapter 21 Water Supply Rule.
Vermont Proposed Rule: 04P030
AGENCY: Vt. Agency of Natural Resources
CONCISE SUMMARY: The changes to this rule focus on improving health protection, meeting federal requirements for protecting public drinking water quality, and clarifying existing requirements. Major changes not required for federal primacy include requirements for bottled water systems; prohibiting the long-term use of an emergency source; requiring fee payment; changing the monitoring and contaminant standards for Non-community public water systems; requiring O&M manuals for NTNC & Bottled water systems, requiring standby disinfection at NTNC systems; requiring notification when a break-in occurs; requiring an annual TNC report; eliminating bottle water cap submittal; revising bulk water hauling standards; creating a new water system operator class; changing duties of operators; changing constant discharge test requirements; allowing below grade reservoirs; and removing the Federal Register from the rule.
TYPE OF PERSONS AFFECTED: Public Water Systems, the public, public water system operators, laboratories, Vermont Department of Health, and US EPA.
COST BENEFIT ANALYSIS: The economic impact varies depending upon the type of water system and its components. The changes in the rule could have no economic impact to a significant impact on a water system. The highest costs are expected to be associated with changes due to federal requirements. These costs are offset by improved public health and welfare protection. The protection value could be quite large given the potential for chronic and acute diseases associated with bacteriological and chemical contamination.
SCHEDULED HEARINGS: September 8, 2004 from 4-6 pm at the Pavilion Building Auditorium, State Street, Montpelier and September 9, 2004 from 3-5 pm at the Rutland Free Library, Court Street., Rutland.
