PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Vermont Use of Public Waters Rules - 2004 Proposed

Vermont Proposed Rule: 04P027 

AGENCY: Vermont Water Resources Board 

CONCISE SUMMARY: The proposed amendments consist of: (1) a rule requested by petition that would prohibit the use of internal combustion motors on Mirror Lake in the Town of Calais and (2) a rule requested by petition that would modify the portions of the rules pertaining to use and operation of personal watercraft or any other Class A vessel, which uses an inboard engine powering a water jet pump, on Lake Willoughby in the Town of Westmore. 

TYPE OF PERSONS AFFECTED: The people, enterprises and government entities potentially affected by the proposed rules include persons who use the affected bodies of water for recreational or other purposes, riparian property owners, camp owners on the affected bodies of water that own jet skis or vessels with internal combustion engines, businesses dependent on recreational uses of the affected body(ies) of water(s), retailers and manufacturers of jet skis, the municipality(ies) in which the affected waters are located, the Vermont Department of Public Safety and the Vermont Agency of Natural Resources. 

COST BENEFIT ANALYSIS: With regard to the proposal to ban jet skis on Lake Willoughby, there may be an economic impact to manufacturers and retailers of jet skis.  This is particularly true in light of the fact that the Board has banned the use of jet skis on several nearby water bodies, namely Caspian Lake, Norton Pond, Little Averill Pond, and Great Averill Pond. There may be an economic impact to businesses dependent upon recreational users of the affected bodies of water to the extent that the prohibitions requested affect the number of tourists and recreationalists that utilize the lakes.  The Board uses the public hearing process to assist it in determining whether the impact on businesses dependent upon recreational users of the affected bodies and/or the jet ski industry, will be beneficial (more people will visit the Lake(s) as a result of the rule change), detrimental (less people will visit the Lakes(s) as a result of the rule change) or neutral.

Administrative Rules for Private Investigative and Security Services

Vermont Proposed Rule: 04P028 

AGENCY: Secretary of State, Office of Professional Regulations

CONCISE SUMMARY: The proposed rules mainly address the new statutory requirement that all new registrants complete a 40 hour training program.  These rules set the parameters for course requirements, subject areas and instructors.  The rules also address individual licensure requirements, firearms instructors, and the duties of qualifying agents.

 TYPE OF PERSONS AFFECTED: Security guards and private investigators. Security and private investigative agencies. consumers of security and private investigative services.  Firearms instructors.  Office of Professional Regulation. 

COST BENEFIT ANALYSIS: New applicants for registration will require 40 hours of training which may mean development of an in-house training program or sending new employees to an outside training program.  Some individuals may seek training on their own, or some employers may require the employees to pay for their own training.  The rules also clarify the license structure of agencies and qualifying agents. There will be separate licenses for agencies and for individual private investigators and security guards, but sole practitioners will only be required to carry one license.  This reverses prior practice of issuing one license to the agency and qualifying agent.
